All transactions between GM Waterproofing and the Client are subject to the terms and conditions detailed below.
1. Validity of Quotation
All quotations remain valid for a period of 30 days from the date of issue.
2. Guarantee Exclusions
GM Waterproofing does not offer guarantees against rust, dampness, cracking, or hail damage.The presence of rust on any roof structure will automatically void the guarantee.Any damage resulting from hail, including holes in the waterproofing layer, will also nullify the guarantee and should be addressed through the client’s insurance provider.
3. Waterflow Systems
If stormwater outlets or waterproofed areas are found to be blocked, contaminated, or otherwise compromised, any applicable guarantee will be considered void.
4. Third-Party Interference
Any tampering, alteration, or repairs by a third party will render the guarantee null and void.
5. Guarantee Options and Maintenance
GM Waterproofing offers various guarantee options depending on the product or service selected:
10-Year Guarantee: This guarantee is subject to mandatory maintenance, which must be initiated by the client. All maintenance costs will be the responsibility of the client. Failure to schedule the required maintenance will render the guarantee void. Clients are advised to contact GM Waterproofing at least one month before the scheduled maintenance interval to arrange for an inspection and to receive a maintenance quotation. Full particulars of the guarantee will be discussed upon final completion of the project.
6. Patch Waterproofing:
Typically not covered by a guarantee unless otherwise stated after a full site inspection.
7. Limited Guarantees (1–5 years):
May be issued in specific cases and will be clearly stipulated in the initial quotation.All damage caused by hail or third parties must be reported immediately for quotation and assessment.
8. Guarantee Expiry:
Guarantees will automatically lapse if GM Waterproofing is not contacted by the client before the expiry date. No claims can be made post-expiry without prior inspection or agreement.
9. Special Cases:
Certain jobs may only qualify for a limited guarantee (e.g. 1–2 years), depending on site conditions or materials used. These will be outlined clearly in the provided quotation.
10. Maintenance Responsibility
All ongoing maintenance costs are the responsibility of the client.
11. Guarantee Activation
No guarantees will be issued unless the full invoice has been paid and cleared.
12. Tile Matching Policy
When required, GM Waterproofing will source tiles that closely match the existing roof tiles in both color and availability. If an exact match is not obtainable, GM Waterproofing will repair the tiles and apply color-matched waterproofing paint to blend as closely as possible. This is standard practice in our restoration services.
13. Site Access
The Client agrees to provide GM Waterproofing with uninterrupted and timeous access to the site for the full duration of the contract period. Any delays caused by restricted access may result in additional costs or project delays.
14. Client’s Responsibility for Personal Property
It is the Client's sole responsibility to remove or protect all furniture, fixtures, fittings, vehicles, and any other belongings from the work area to prevent potential damage. GM Waterproofing shall not be held liable for any such damages.
15. Limitation of Liability
The Client agrees to indemnify and hold GM Waterproofing and its personnel harmless from any claims, damages (including consequential or unforeseen damages), loss of income, delays, or liabilities suffered by the Client or any third party during the execution of the contracted work.
16. Hidden or Unforeseen Issues
The quotation excludes any hidden issues not visible during the initial site assessment. If additional remedial work is required due to unforeseen problems, GM Waterproofing will issue a separate quotation for the Client’s approval and account.
17. Additional Work Requests
If the Client requires work outside the scope of the original quotation, such requests must be communicated to GM Waterproofing in writing. A separate quotation will be issued, and additional costs will be borne by the Client.
18. Partial Acceptance of Quote
Should the Client not accept the quotation in full, GM Waterproofing reserves the right to revise the scope, pricing, and applicable guarantee periods accordingly.
19. Scope Limitation
GM Waterproofing will only be responsible for work explicitly detailed in the quotation. Any remedial work not listed is excluded from our obligations.
20. Existing Cable & Plumbing Risks
While every effort will be made to avoid damaging existing TV, electrical, or plumbing lines, GM Waterproofing will not be held liable for damages to such systems, as they may be degraded or brittle due to age or UV exposure.
21. Skylight Glass Disclaimer
Extreme care will be taken when working near or with skylight glass panels; however, GM Waterproofing accepts no liability for breakage, as prolonged exposure to UV rays can render such materials fragile.
22. Roof & Gutter Maintenance
The Client is responsible for keeping roofs, gutters, and stormwater outlets clear of debris, leaves, and obstructions. Failure to do so may void any applicable guarantee.
23. Quotation Errors and Omissions
GM Waterproofing will not be bound by bona fide errors or omissions within the quotation document. The company reserves the right to amend the quotation if such discrepancies are discovered.
24. Excluded Areas
Any areas not specifically listed in the quotation are excluded from the agreed scope of work.
25. No Oral Amendments
No verbal agreement or discussion shall override any terms of this contract. Only written agreemsts will be deemed binding on the parties.
26. Contract Amendments
Any changes to the agreement—including scope, time frames, pricing, or other terms—must be documented in writing and signed by both the Client and an authorized representative of GM Waterproofing.
27. Ownership of Materials
All materials, products, and equipment supplied or installed by GM Waterproofing will remain the property of GM Waterproofing until full payment has been received.
28. Undertile Insulation
Undertile insulation is not included in the quotation unless explicitly mentioned and priced for separately.
29. Structural Defect Disclaimer
GM Waterproofing is not liable for any structural defects present in the building or roofing substrate. Should waterproofing fail due to underlying structural issues, any associated guarantee will be null and void.
Exclusions of Liability / No Guarantee
GM Waterproofing does not offer guarantees on the following:
1. Tile shifting or cracking due to natural causes, structural movement, or interference by third parties.
2. Dampness or cracking in ceilings, walls, or concrete slabs under any circumstances. Leaking stormwater outlets or downpipes.
3. The occurrence or recurrence of rust on any surface or structure.
Additional Terms & Conditions for Guttering Installations:
1. All guttering supplied and installed by GM Waterproofing carries a 3-year guarantee against rust and corrosion, as well as a 3-year workmanship guarantee.
2. Safety files can be provided upon request at an additional cost, which is calculated based on the project size and duration.
3. Existing guttering systems will be dismantled and removed from site. Once removed, they will be discarded and cannot be returned.
4. While reasonable care will be taken around plants, creepers, and shrubs, GM Waterproofing accepts no liability for any damage to vegetation during the installation process.
5. Where scaffolding, skyjacks, or other elevated access equipment is required, an additional quotation will be submitted.
6. Gutter drainage will be installed with care. However, if the roofline is uneven or slopes incorrectly toward the intended drainage points, gutters will be installed in the most effective configuration possible without compromising roof structure (e.g., tile or sheet lifting).
7. If excessive overhang or structural adjustments are required to ensure proper gutter fitment, GM Waterproofing reserves the right to issue a further quotation for roof modification.
8. Gutters will be installed level and in alignment with industry standards to ensure optimal performance.
9. Downpipes may be repositioned if necessary to ensure effective water runoff and system efficiency.
10. Additional downpipes, splash plates, or spacers may be recommended and installed at an added cost to the Client.
11. The condition of existing fascia boards and tilting battens can only be assessed once the old guttering is removed. Any deterioration or rot found will be addressed at an additional cost.
